What is a Deposition?
Depositions are compilations of facts and testimonies used to benefit an attorney’s case. Attorneys use depositions to formulate strategies that help them win the case. When witnesses are called for a deposition, they are questioned under oath. Each of these questions and answers are recorded by our court reporting professionals and later used for analysis and evidence.
The Purpose of a Deposition
Depositions are not required by law, but they do play a massive part in crafting a cohesive narrative and timeline of events for the judge and jury. The deposition allows the attorney and their client to discern what should be presented to shine the best light upon their story. For the opposing counsel, depositions are essentially investigative periods. By having this prep period, both counsels are able to find flaws or inconsistencies in the opposition’s story, which can then be pointed to during the trial.
Forming a Solid Defense
If one thing is true about a deposition, it is that consistence is key. Errors in consistences are major points of contention for the judge, jury, and opposing counsel. The best way to ensure consistency is to tell the truth. Remind your client and witnesses to speak slowly and clearly during questioning. Have them wait until the attorney is completely finished asking their question before answering, so to ensure the most appropriate response is given. Tell them not to be afraid of asking for clarification when questions are unclear or vague. This sort of thin can be the difference between a successful and unsuccessful case.
