Differences Between Remote and In-Person Depositions

Whether you’re in an office space or at your dining room table, depositions are held for the same purpose: to gather a profile of facts and testimonies that regard an attorney’s case. Court reporters are crucial to the deposition process, as they record the questions and answers exactly as they transpire to form an accurate transcript that can be used for analysis. 

With more and more people turning to remote depositions in order to fulfill their legal needs, questions about the difference in preparation arise. While there are mostly similarities between these two deposition options, there are definitely some differences once must take into consideration when holding a remote deposition.

When Preparing for Remote Depositions…

  • Make sure all parties involved agree to a remote deposition. 
  • Share any and all documents and exhibits with all participants (including opposing counsel, witnesses, and your court reporter).
  • Prepare your external webcam and microphone, or use a device that comes with a built-in webcam and microphone.
  • Check that your internet connection will support a video call.
  • Make sure your background and attire is clean and professional.
  • Eliminate all the background noise that you can.
  • Do not speak over another person. Speak slowly and clearly to ensure you are properly heard.

When Preparing for an In-Person Deposition…

  • Reserve your meeting space with ample time.
  • Book any necessary equipment early.
  • Plan out travel time and any expenses that might come with it.
  • Arrive at the meeting space early.
  • Ensure all equipment is properly working and prepared.
  • Dress for court.
